HALLE BERRY'S EX WANTS A FORTUNE IN CHILD SUPPORT

Gabriel Aubry is asking the judge in his custody war with Halle Berry for a half a million bucks in attorney's fees, and $20,000 a month in child support, TMZ has learned.

Gabriel was in court this morning, expecting to argue his case for the huge increase in child support, but the case was continued because the paperwork wasn't filled out properly.  Gabriel was extremely upset the matter was put off.

Sources tell us ... Gabriel believes he's entitled to the money because he needs a proper environment to care for 4-year-old Nahla. As we first reported, Halle wants to move with the child to Paris, which would have a direct impact on Gabriel's request for additional support.

OLIVER MARTINEZ CONFIRMS ENGAGEMENT TO HALLE BERRY!

 

 They were first reported to be on their way to wedlock back in mid-January, but days later it became unclear as to whether or not Halle Berry and Olivier Martinez were actually engaged due to uncertainty surrounding the jeweler who leaked the news' story.

Fast forward two months and now we have an official answer, as Martinez confirmed on Saturday (March 10) that he and the Oscar-winning actress are, indeed, engaged to be married!

While on-hand for the grand opening of his new South Beach restaurant Villa Azur, the French actor was asked by Miami.com if the engagement claims were for real, to which he replied, "Yes, of course it's true!"

As for the confusion that had arisen back in January, Olivier told that Gurhan Jewelry falsely claimed to have crafted the couple's rings, as he dished, "There is a jeweler taking credit for doing the ring and it's a lie! They have nothing to do with this."

Martinez added that the real ring designer was a jeweler from his Saint-Germain-des-Prés neighborhood in Paris named Robert Mazio, who's a "real artist" that has put together pieces for numerous French royals throughout his days.

 

HALLE BERRY'S EX GABRIEL AUBRY: CLEARED OF CHILD ENDANGERMENT

 There’s finally some good news for Gabriel Aubry- yesterday (March 8) a Los Angeles judge dismissed the child endangerment case filed against him by a former nanny.

The Los Angeles County Department of Family and Children Services determined that there was no threat posed to Gabriel’s daughter Nahla, so the court closed the case.

Still, Mr. Aubry is fighting to get custody of the 4-year-old, given that her mother Halle Berry is desperately trying to get permission to move to her to France.

Halle claims that she’s not safe living in the USA, and hence needs to relocate to France where she’ll live with her boyfriend Olivier Martinez. If granted, the new situation will make visitation highly complicated for Aubry.

GABRIEL AUBRY WANTS MORE MONEY FROM HALLE BERRY

Gabriel Aubry, who is currently fighting Halle Berry for custody of their 3-year-old daughter Nahla, is now asking Halle to pay him $15,000-$20,000 per month to cover his living expenses.

He’s also trying to get Halle to give him money to pay for Nahla’s clothes, and for his trips to Canada to visit his family with the kid. Gabriel and Halle will be in court on April 9 to duke it out.

HALLE BERRY FIRES LONGTIME LAWYER HIRES LEGAL BULLDOZER

Halle Berry has dumped another man ... but this one has been with her way longer than all the others -- her longtime lawyer/confidante, Neal Hersh ... TMZ has learned.

Here's the lowdown.  Our sources tell us Halle wants to go after her baby daddy Gabriel Aubry with nuclear weapons -- metaphorically speaking -- and she thinks Hersh is too much of a gentleman to wage that kind of legal war, even though he has guided Halle through 2 divorces, a custody war and various other legal skirmishes.

So we've learned Halle has hired Stephen Kolodny (above), who is legendary in L.A. legal circles for the level of legal warfare she so wants.  You may recall Kolodny repped Mel Gibson in his epic battle with Oksana Grigorieva -- and that got kinda nasty.

Kolodny has already gone to court with Halle. We've learned last Thursday the new duo went to dependency court to have more restrictions placed on Aubry.  The dependency judge has already ordered that Gabriel can only have contact with Nahla in the presence of a monitor. On Thursday, we're told the judge voiced additional concerns and ordered Gabriel to return the child to Halle earlier than the 6 PM deadline on days he has custody.

Kolodny will have his hands full trying to convince the family law judge that Halle should be able to move to France with the child because she's concerned about paparazzi and safety.

One thing's for sure ... it's gonna get nasty.

Hersh and Kolodny could not be reached for comment.

MY FIANCE HAS NAHLA'S BACK - HALLE BERRY

Halle Berry's fiance Olivier Martinez proved he's strong enough to carry the family ... or at least Nahla ... during a fancy dinner date in Malibu this weekend.

After hearing the good news about Halle's stalker being re-captured by authorities, the gang hit up Nobu Saturday night.

Nahla looked pretty comfortable with Olivier ... tightly embracing the guy as he carried her out to the car.

As TMZ first reported, Nahla has issues with the other man in her life ... her father Gabriel Aubry ... telling the L.A. Department of Children and Family Services she's scared of him. Gabriel is now only allowed to see Nahla with a monitor present.

NAHLA MY DADDY SCARES ME

Gabriel Aubry has been accessed of multiple incidents of child neglect and endangerment ... and one of the accusers is 3-year-old Nahla, TMZ has learned.

Sources tell us the L.A. Department of Children and Family Services conducted numerous interviews with people familiar with the relationship between Gabriel, Halle Berry and Nahla. We're told DCFS now has numerous incidents that have raised concerns about Gabriel’s ability to properly parent his child.

We're told DCFS conducted an interview with Nahla, who talked about her father and described incidents involving him screaming at her --  and how it made her extremely frightened.

Our sources say DCFS has information about Gabriel  yanking the child out of the nanny’s hand, allegedly pushing the nanny while holding the child, and putting the child in harm’s way while Halle was shooting movie in Europe.

As TMZ previously reported, the Dependency Court ordered that Gabriel can only have contact with his daughter in the presence of a monitor to ensure the safety of Nahla. But we're told that is just the beginning ... there will be numerous other hearings, as well as additional requirements that Gabriel must fulfill, which will include various forms of counseling.

As we reported earlier, Gabriel agreed to anger management counseling ... but we're told the Dependency Court will order more than that.

Just a note ... Dependency Court is different from the family court where Garbiel and Halle have been frequent visitors over the past year. Dependency Court is designed specifically to protect a child when there are signs of neglect or abuse. Being hauled into Dependency Court is far more serious than a family law skirmish.

GABRIEL AUBRY CAN'T BE TRUSTED ALONE ... WITH NAHLA

Gabriel Aubry is being watched ... watched by a monitor whenever he's with Nahla ... 'cause a judge ruled he can't be trusted with the child alone, at least for now.

TMZ broke the story ... Halle Berry's baby daddy was ordered into Dependency Court today after the L.A. Department of Children and Family Services concluded its investigation. As we reported, DCFS not only looked at an incident in which Gabriel allegedly pushed a nanny while she was holding Nahla, but other incidents as well.

We're told DCFS had information that Gabriel had yanked the baby from the nanny's arms on at least one occasion and screamed at Nahla multiple times.

We're told DCFS had extensive information that it had reviewed and then recommended a monitor for Gabriel when he has Nahla.

We're told .. the judge agreed this morning and put the monitor in place after a hearing.

HALLE BERRY I'M MOVING TO EUROPE ...WITH MY BOYFRIEND AND NAHLA

Halle Berry is asking the judge in her custody war for permission to move to France with Nahla -- and baby daddy Gabriel Aubry is saying ... over my dead body.

TMZ has learned Halle filed papers with the court requesting the move and the hearing is pending. Sources tell us Gabriel is livid because he believes the move is punitive and designed to strip him of any contact with his daughter.

And Gabriel is particularly upset because Halle's longtime boyfriend Olivier Martinez will be living with Halle and Nahla if the move is approved ... informed sources tell TMZ.

Halle could have an argument that it's safer for Nahla to be in Europe ... especially because her latest stalker -- who broke onto her property multiple times -- has recently been released from jail.

GABRIEL AUBRY AGREES TO ANGER MANAGEMENT

Halle Berry and Gabriel Aubry met for hours Friday with representatives from the Los Angeles County Department of Children and Family Services ... and social workers concluded Gabriel needed to work on his anger issues ... law enforcement sources tell TMZ.

We're told DCFS recommended that Gabriel take anger management classes and our sources say he agreed to enroll. 

As one law enforcement source told us who is connected to the case, "Gabriel has a little bit of a temper, but the good news is that he realizes it."

The recommendation stems from an incident earlier this month in which Gabriel allegedly pushed the nanny while she was holding Nahla.  Our sources say Gabriel told social workers he never touched the nanny and she was making the story up to curry favor with Halle.

Our sources say DCFS is not making any recommendations on changing the custody arrangement.

 That will be left to the judge on Monday morning ... when Halle and Gabriel square off
again in court.

As we first reported ... there's also a criminal investigation focusing on child endangerment and battery.  Our law enforcement sources tell us they are confident Gabriel will NOT be prosecuted because it's a "he said she said" case. We're told the matter will be referred to the L.A. City Attorney next week but it's expected the Office will decline to prosecute.

HALLE BERRY TO GABRIEL AUDRY STAY AWAY FROM NAHLA!!!

Halle Berry has just arrived at court, where she'll ask a judge for an order prohibiting her baby daddy, Gabriel Aubry, from having ANY contact with 3-year-old Nahla until the child endangerment investigation against him is resolved.

As TMZ first reported, the LAPD is conducting a criminal battery and child endangerment investigation after Gabriel allegedly pushed the nanny with Nahla in her arms. And before the alleged pushing, the nanny says Gabriel screamed at her and hurled a racial epithet. In addition, we've learned the L.A. County Dept. of Children and Family Services is also conducting a child endangerment investigation.

TMZ has learned more about what nanny Alliance Kamdem has told the cops. Law enforcement sources tell us ... Kamdem claims Gabriel repeatedly yelled and cursed at her, often while Nahla was present. Kamdem also says it got so bad ... Gabriel would make her sit in a corner in his condo until he called for her.

Kamdem also claims Gabriel often yelled at Nahla, causing the child to cower and cry. And she told police ... when Nahla had a rash he refused to treat it.

Kamdem quit last week after Gabriel allegedly shoved her.

Gabriel's rep tells TMZ, "Anyone can file a police report at any time, regardless of it being accurate."

As for Halle's court appearance later this AM ... we'll be there.

HALLE BERRY'S NEW MAN MOVES THE WEB

Halle Berry, care to amend your statement? The Oscar winner was adamant in 2004 when she told Oprah, and the world, "I will never marry again. I mean it with every bone in my body." But according to many reports, the star has had a change of heart, becoming engaged to the actor Olivier Martinez. The gossip magazine Us Weekly confirmed that the

Frenchman proposed over the holidays with a "one-of-a-kind" emerald-and-diamond ring from Gurhan.The happy news caused searches on Yahoo! to surge on the pair, including "olivier martinez actor," "olivier martinez biography," and "olivier martinez and halle berry."

The two met on the set of "Dark Tide," and went public as a couple in the fall of 2010. Perhaps it's not surprising that Berry was gun-shy of tying the knot a third time. Her two previous marriages ended in divorce: with former baseball player David Justice and then with singer Eric Benet.

Berry's most recent relationship, with ex-boyfriend Gabriel Aubry, resulted in their 3-year-old daughter, Nahla. The split ended in a nasty custody dispute. The man who caught Berry's eye was dubbed "the French Brad Pitt" and has caught notice for his acting abilities on both sides of the Atlantic. HALLE BERRY GETS ENGAGED

Halle Berry is engaged for the third time, this time to Oliver Martinez. Sources say that Oliver gave Halle an emerald and diamond ring from Gurhan over the holidays.

Halle and Oliver met on the set of Dark Tide, and began dating last year.
